NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN THIS PROMOTION
You agree that, by submitting an entry on Pure Storage Twitter, you will be bound by these Official Rules and you acknowledge that you release all rights to the photos and your name, for general viewing and use by Pure Storage, Inc. By participating in this Promotion, you completely release Twitter of any liabilities, acknowledge that the promotion is in no way sponsored, endorsed or administered by, or associated with Twitter and acknowledge that you are providing information to Pure Storage, Inc. and not to Twitter. Eligible Participants entering the Promotion agree to follow the Twitter Terms of Service and Twitter Rules.
1. SPONSOR & PROMOTION DESCRIPTION
The Pure Storage No Time for Disk Promotion (the "Promotion") is sponsored by Pure Storage, Inc. (the "Sponsor"), 650 Castro Street, Mountain View, CA 94041 USA. The Promotion consists of eligible Participants (the "Participant") that submit an eligible entry (the "Entry"). The Promotion begins on May 15, 2014, at 6:00a.m. PST and ends August 31, 2014, at 11:59p.m.PST (the "Promotion Period"). At the end of the Promotion Period, Sponsor will send a free t-shirt (the "Reward") to all eligible Participants (while supplies last). No cash alternative or substitution of prizes will be allowed, except Sponsor reserves the right in its sole discretion to substitute prizes of comparable value if any prize listed is unavailable, in whole or in part, for any reason. This Promotion is void where prohibited. Entry in the Promotion does not constitute entry into any other promotion, contest, or sweepstakes. There is a one (1) entry per Participant allowed during the Promotion Period.
2. ELIGIBILE PARTICIPANTS
The Promotion is open only to eligible Participants that: (i) have not adopted a policy that prohibits its representatives from accepting promotion rewards from third parties; (ii) is not a governmental organization nor partly state owned or controlled; and (iii) are not seeking employment from Sponsor; (b) meet all of the eligibility requirements of the Promotion Official Rules; (c) are eighteen (18) years old or older as of time of entry; (d) are legal U.S. residents of the fifty (50) United States; (e) are not an officer, director, employee, intern or independent contractor or competitor of Sponsor, its subsidiaries, affiliates, distributors, resellers, sales representatives or advertising and promotion agencies; and (f) do not have immediate family members and/or people living in the same household (parents, grandparents, children, grandchildren, step-parents, step children, siblings, step-siblings, spouses and domestic partners) that are related to Sponsor’s employees, interns, independent consultants, suppliers, resellers, partners, distributors or competitors. All eligibility for this Promotion is subject to these Official Rules and all applicable U.S. federal and state laws.
3. HOW TO ENTER THE PROMOTION
Upload an ethical photo of yourself (an eligible Participant) and your storage array to Twitter with @PureStorage and one or both of the hashtags: #LoveYourFlash or #NoTime4Disk.
You may enter the Promotion between May 15, 2014 beginning at 12:01 AM and August 31, 2014, 11:59p.m.PST. All eligible submissions will receive a free t-shirt from Sponsor (while supplies last). Any entries uploaded after 11:59p.m.PST on August 31, 2014 will not be eligible for this Promotion or a Reward. No exceptions will be made. Only (1) entry per Participant is allowed. Multiple entries in a single day will not be accepted. Only photos that are posted on Twitter with @PureStorage and one or both of the hashtags: #LoveYourFlash or #NoTime4Disk are eligible to win. Only photos taken by the eligible Participant posting the material are eligible to win. No copyright material is eligible for posting or winning. Any entry found to use multiple Twitter accounts to enter the Promotion would be ineligible. Sponsor reserves the right to remove photos it deems lewd or indecent without notice or explanation. It is at the sole discretion of Sponsor what it considers inappropriate and unsuited for general public viewing. Sponsor may promote the submitted photos or use them in promotion without additional permission or credit.
4. HOW TO RECEIVE REWARD
After the Promotion Period ends, Sponsor will mail the Reward within four (4) to six (6) weeks of Reward winners being verified and approved by Sponsor (while supplies last). Reward winners will be notified via a direct message on Twitter and you agree to provide Sponsor with your mailing address in order to receive the Reward. Sponsor will select an alternative potential Reward winner if a Reward winner does not respond to Sponsor's direct Twitter message within ten (10) days of notification, or fails to meet the eligibility criteria. Your entry or claim may be disqualified, at the sole discretion of Sponsor if you attempt to enter through any means other than the entry methods mentioned above or otherwise provided in the Official Rules, or if you disrupt the Promotion or circumvent the terms and conditions of these Official Rules. If either of the above occurs, Sponsor has the right to remedy any such action, disruption, or circumvention in a matter to be solely determined by Sponsor.
5. ADDITIONAL TERMS
AS AN ENTRANT IN THIS PROMOTION, YOU AGREE THAT SPONSOR, ADMINISTRATOR, TWITTER, THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, ADVERTISING, PROMOTION AND PRODUCTION AGENCIES AND PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS OR EMPLOYEES (COLLECTIVELY, THE “RELEASED PARTIES”), SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSSES, DAMAGES OR INJURIES OF ANY KIND RESULTING FROM YOUR PARTICIPATION IN THE PROMOTION OR ANY PROMOTION-RELATED ACTIVITY, OR FROM YOUR ACCEPTANCE, RECEIPT, POSSESSION AND/OR USE OR MISUSE OF THE PRIZE(S), AND (B) HAVE MADE ANY WARRANTY, REPRESENTATION OR GUARANTEE EXPRESS OR IMPLIED, IN FACT OR IN LAW, WITH RESPECT TO THE REWARD(S), INCLUDING, WITHOUT LIMITATION, TO SUCH REWARD’S QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. Sponsor assumes no responsibility for any damage to your computer system which is occasioned by participation in the Promotion, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or intercepted Promotion entries or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites (including the Promotion Website), or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected tweets, or computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Promotion, or to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event Sponsor is prevented from awarding reward(s) or continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Promotion. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor.
By entering the Promotion, you agree: (i) to be bound by these Official Rules and by all applicable laws and decisions of Sponsor and Administrator which shall be binding and final; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of rights to bring any claim, action, or proceeding against Twitter or any and all of the Released Parties in connection with the Promotion; and (iv) to forever and irrevocably agree to release, defend, indemnify, and hold harmless Twitter and any and all of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability costs and expenses (including, without limitation, reasonable outside attorneys’ fees) that may arise in connection with this Promotion.
By participating in this social media promotion and posting to Twitter, you must (i) make no false or misleading representations or advertisements with regard to Sponsor or your relationship with Sponsor; (ii) make no statements regarding Sponsor that you do not have a reasonable basis for or that are inconsistent with your honest opinions, findings, beliefs, or experiences; (iii) disclose the nature of your relationship with Sponsor and that you may be eligible for prizes as a result of your posting; (iv) comply with all applicable laws and regulations, including but not limited to advertising and marketing laws such as CAN-SPAM and the Federal Trade Commission’s Endorsement Guidelines; (v) comply with the social media outlets’ terms of service and other policies; and (vi) comply with any other policies of Sponsor and Twitter as may be communicated to you during the Promotion Period.
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
6. DATA PRIVACY
All Participants agree that their personal data, especially name, email address and telephone number, may be processed, stored and otherwise used in the United States for the purposes and within the context of the Promotion and any other purposes outlined in these Official Rules in accordance with Sponsor’s privacy policy posted at http://www.purestorage.com/privacy/ and Twitter's Privacy Policy posted at https://twitter.com/privacy. Participants further agree that the data may also be used by the Sponsor in order to check entrants’ identity, their email address and telephone number, or to otherwise verify their eligibility to participate in the Promotion.
