PURE STORAGE VALENTINE DAY CUSTOMER REFERRAL PROMOTION
OFFICIAL RULES – NO PURCHASE NECESSARY
1. SPONSOR & PROMOTION DESCRIPTION
The Pure Storage Valentine Day Customer Referral Promotion (the "Promotion") is sponsored by Pure Storage, Inc. (the "Sponsor"), 650 Castro Street, Mountain View, CA 94041 USA. The Promotion consists of employees employed by current customers of Sponsor (the eligible "Participants" as identified in Section 2) that submit eligible customer referrals (the "Referral") via the method entries identified in Section 3. The Promotion begins on February 10, 2014, at 10:00a.m.PST and ends February 28, 2014, at 11:59p.m.PST (the "Promotion Period"). At the end of the Promotion Period, Sponsor will conduct a random drawing (the "Drawing") from among all eligible Participants that will result in ten (10) Reward winners. Each Reward winner selected amongst eligible Participants will win a $500USD Visa Gift Card (the “Reward”). The gift card Rewards are subject to the terms and conditions printed thereon and imposed by issuer. No cash alternative or substitution of prizes will be allowed, except Sponsor reserves the right in its sole discretion to substitute prizes of comparable value if any prize listed is unavailable, in whole or in part, for any reason. Visa Corporation is not affiliated in any way with the Sponsor of the Promotion. By participating in the Promotion, each Participant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects. This Promotion is void where prohibited. Entry in the Promotion does not constitute entry into any other promotion, contest, or sweepstakes. There is a one (1) entry limit per Participant during the Promotion Period. All federal, state, and local taxes, fees, and duties are the sole responsibility of the Participant. Promotion shall be constructed and evaluated according to California Law, USA.
2. ELIGIBILE PARTICIPANTS & REFERRALS
The Promotion is open only to eligible Participants that: (a) are employees of Sponsor’s paying customers during the Promotion Period that; (i) have not adopted a policy that prohibits its representatives from accepting promotion rewards from third parties; (ii) is not a governmental organization nor partly state owned or controlled; and (iii) are not seeking employment from Sponsor; (b) meet all of the eligibility requirements of the Promotion Official Rules; (c) are eighteen (18) years old or older as of time of entry; (d) are legal U.S. residents of the fifty (50) United States; (e) are not an officer, director, employee, intern or independent contractor of Sponsor, its subsidiaries, affiliates, distributors, resellers, sales representatives or advertising and promotion agencies; and (f) do not have immediate family members and/or people living in the same household (parents, children, step-parents, step children, siblings, step-siblings or spouses) that are related to Sponsor’s employees, interns, independent consultants, suppliers, resellers, partners or distributors. All eligibility for this Promotion is subject to these Official Rules, an existing eligible Participant P.O., and all applicable U.S. federal and state laws. An eligible Referral cannot be a competitor of Sponsor, a job seeker seeking employment from Sponsor, a student or a partner of Sponsor.
3. HOW TO ENTER
There are two (2) ways to enter the Promotion:
1. Visit the Sponsor’s Promotion web site located at http://info.purestorage.com/ValentinesDayReferralProgram-February2014_VDayReferral.html, read and comply with the Official Rules located http://info.purestorage.com/ValentinesDayReferralProgram-February2014_Terms.html. Refer eligible Referrals (“Friends” on online submission form) by filling in the required fields on the form. After you fill out all required fields, click “submit,” and you will automatically be entered into the Drawing for a chance to win a Reward. Any Referrals submitted online after February 28, 2014, 11:59p.m.PST, will not be eligible for this Promotion. No exceptions will be made.
2. Hand print your first and last name, complete address, current phone number and your Referral’s first and last name, company name, company address and a current email address or current telephone number either on a postcard or on a separate piece of paper no larger than 8½ x 11 inches, and mail the entry to "Pure Storage Valentine Day Customer Referral Promotion” ATTN: Marketing - 650 Castro Street, Mountain View, CA 94041. Mail-in entries must be postmarked by February 28, 2014 and received by Sponsor by March 8, 2014. Limit one (1) entry per envelope. Mechanically reproduced or hand stamped entries will not be accepted. Incorrect, illegible, and incomplete entries are void.
4. HOW WINNERS WILL BE DETERMINED
After the Promotion Period closes, Sponsor will conduct a Drawing on or around March 10, 2014 and there will be ten (10) Reward winners chosen from the Drawing. The ten (10) Reward winners will be notified by email or telephone upon verification and approval by Sponsor and be required to execute an Affidavit of Eligibility and Waiver of Liability and return a fully executed original within three (3) business days of date that Participant acknowledged Sponsor’s notification. The Rewards will be mailed to each of the ten (10) Reward winners within four (4) to six (6) weeks of Reward winners being verified and approved by Sponsor. If Sponsor is unable to contact a Reward winner within three (3) business days of the initial attempt, if the potential Reward winner fails to return a fully executed Affidavit of Eligibility and Waiver of Liability or if the potential Reward winner fails to comply with these Official Rules, his/her place as a potential Reward winner will be forfeited at Sponsor's discretion.
Only approved claims meeting the requirements set forth herein will be eligible to earn Rewards under this Promotion. Duplicate entries of the same claim form and/or other mechanical reproductions of entries are not permitted. Illegible or incomplete entries or claims will be disqualified. Your entry or claim may be disqualified, at the sole discretion of Sponsor if you attempt to enter through any means other than the two entry methods mentioned above or otherwise provided in the Official Rules, or if you disrupt the Promotion or circumvent the terms and conditions of these Official Rules. If either of the above occurs, Sponsor has the right to remedy any such action, disruption, or circumvention in a matter to be solely determined by Sponsor.
5. GENERAL
AS A PARTICIPANT IN THIS PROMOTION, YOU AGREE THAT NEITHER SPONSOR NOR THE PROMOTION ENTITIES: (A) SHALL BE RESPONSIBLE OR LIABLE FOR ANY LOSSES, DAMAGES OR INJURIES OF ANY KIND RESULTING FROM YOUR PARTICIPATION IN THE PROMOTION OR ANY PROMOTION-RELATED ACTIVITY, OR FROM YOUR ACCEPTANCE, RECEIPT, POSSESSION AND/OR USE OR MISUSE OF REWARDS, AND (B) HAVE MADE ANY WARRANTY, REPRESENTATION OR GUARANTEE EXPRESS OR IMPLIED, IN FACT OR IN LAW, WITH RESPECT TO THE PROMOTION, INCLUDING, WITHOUT LIMITATION, TO QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or intercepted Promotion entries, claim forms, or reward notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites (including the Promotion website), or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected emails or tweets, or computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Promotion, or to be acting in violation of these Official Rules or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event Sponsor is prevented from awarding Rewards or continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite, network or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Promotion. If, for any reason, the Promotion is not capable of running as originally planned, the Sponsor at its sole discretion, reserves the right to cancel, suspend or modify the Promotion or any portion(s) thereof and award rewards in a manner that is fair and equitable as solely determined by Sponsor.
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Except where prohibited by law, Participants agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or the reward awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for California or the appropriate California State Court, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees, and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. This Promotion is governed under the laws of the State of California.
